20101122 - PRIVATE INTERNATIONAL LAW

The course will cover the body of the Italian rules on private international law and jurisdiction, and focus specific issues in detail. Special attention will be devoted to the development of the European Union rules aiming at harmonizing the law in force in Member States and creating a European judiciary area, founded on common rules relating to jurisdiction and recognition of judgments. In this respect, the national and EU case law, which will be frequently referred to during the course, plays a central role.

Principles, methods and techniques of private international law.

Jurisdiction and the recognition and enforcement of judgments in civil and commercial matters.

The European Enforcement Order for uncontested claims.

The law applicable to contractual obligations.

The law applicable to non-contractual obligations.

Jurisdiction, the recognition and enforcement of decisions in matrimonial matters and the matters of parental responsibility, and international child abduction.

Jurisdiction, applicable law, recognition and enforcement of decisions and acceptance and enforcement of authentic instruments in matters of succession and the creation of a European Certificate of Succession.

Students attending the course will be assessed with a written test, taking into consideration active participation in class (case presentations, ecc.); non-attending students will be evaluated through oral exam.
