The course aims to provide the students with knowledge and skills that will enable them to know how to frame the organization of public authorities (even in their territorial dimension), the Italian Welfare State system and the constitutional framework of social rights. Furthermore, the teaching purpose is to offer students a reflection on the nowadays condition of people with disabilities, particularly with regard to the detailed study of the disabled people’s constitutional rights and how to effectively protect them. This purpose will be achieved also through the activation of a special Information Desk for students with disabilities, in which the students will be actively involved.
By the study of “Welfare, Social Rights and Territory” the student will be able to achieve the following training objectives.
Knowledge and understanding:
- know how public authorities are organized, including in their territorial dimension;
- know models, tools and strategies to realize a Welfare State system;
- know the social rights provided for in the Constitution, with particular regard to the rights of disabled people and to the institutional apparatus engaged in guaranteeing their effectiveness;
- develop a reflective and project-based attitude towards the current the current implementation of social rights and the rights of disabled people.
Applying knowledge and understanding:
- plan and organize activities aimed at the effective implementation of social interventions;
- apply technical, communicative and relational skills for the realization of activities on the territory, such as the Information Desk for students with disabilities.
Making judgements:
- develop the capacity to understand and evaluate the organization and activities of the institutional apparatus in particular those which guarantee social rights;
- develop a critical and reflexive capacity regarding their own methods of intervention, taking into account the users with whom they deal.
Communication skills:
- acquire the use of a technical-legal language;
- acquire the ability to communicate in public and with the public in a clear and precise manner;
- develop coordination skills with the actors with whom it works;
Learning skills:
- develop the ability to observe the contexts in which it operates and to grasp critical profiles of them;
- develop the ability to learn from confrontation both with experts and with interlocutor users.
How to link with other teachings
The teaching of "Welfare, Social Rights and Territory" is connected in particular with the following subjects of the three-year degree courses, "Institutions of public law", "Constitutional law", "Law of public administrations and territorial policies", "Social rights and ethical dimension in the aid relationship", "Health law"; as well as with the teaching of "Legal institutions and socio-educational services" of the master degree courses.

Type of delivery of the course

Although this is an annual course, the entire program will be carried out during the first semester, both as regards the general part (basic notions of public law, the law of social services, as well as the welfare state and social rights), and as regards the special part of the program (relating to the rights of persons with disabilities). During the second semester, only in-depth seminar meetings will be organized, which will not be the subject of the exam. *** Lessons will take place in person. For those unable to participate, remote connection on the Microsoft Teams platform is provided. To connect, simply access the Microsoft Teams platform and join the Team of the course "AA21 / 22 - Welfare, Social Rights and Territory" where, week by week, lessons will be started, following the indicated times. Lessons will not be recorded.

Attendance

Although the mode of attendance is optional, it is still highly recommended.

Type of evaluation

For students enrolled in the first year of the master's degree program, the exam can only be taken starting from the summer session (obviously students enrolled in subsequent years will already be able to take the exam in the winter session). The exam consists of an intermediate written test (aimed essentially at attending students), at the end of the first semester, and a final oral test, at the end of the second semester. The intermediate written test consists of closed-ended questions, aimed at verifying the basic notions of public law, and open-ended questions, aimed at evaluating knowledge in the field of social services law, welfare state and social rights. The final oral exam aims to assess the degree of knowledge of the rights of people with disabilities within a multilevel guarantee system. For students of degree courses of the Department of Law who have to take the 7 CFU exam, the exam consists of a single final oral exam at the end of the second semester's lessons, which will focus on the reduced program indicated above.
