Sixty years on, bringing the European Social Charter into changed times

Mercoledì 6 ottobre 2021 alle ore 10:15, presso l’Aula Magna del Dipartimento di Giurisprudenza, si terrà un convegno intitolato “Sixty years on, bringing the European Social Charter into changed times”.

L’evento è organizzato dall'Università degli Studi Roma Tre (Dipartimento di Giurisprudenza, Centro Internazionale di Ricerca 'Diritto e Globalizzazione') insieme allo Human Rights Law Centre dell'Università di Nottingham, con il sostegno del Dipartimento della Carta Sociale Europea del Consiglio d'Europa.

Con la partecipazione di relatori esperti e qualificati (accademici, membri del Comitato europeo dei diritti sociali, funzionari del Consiglio d'Europa), la giornata si concentrerà in particolare sulle sfide e le prospettive future della Carta sociale europea.

La “Carta sociale” è il trattato europeo più ampio e completo di protezione dei diritti sociali ed economici, complementare alla Convenzione europea dei diritti dell’uomo, che è invece dedicata ai diritti civili e politici e alle libertà fondamentali. Dai diritti dei lavoratori alla protezione contro la povertà e l'esclusione sociale, dai diritti delle persone con disabilità alle pari opportunità per donne e uomini, dalla tutela della salute ai diritti dei migranti, la Carta con i suoi meccanismi di monitoraggio si è dimostrata uno strumento vivente in grado di affrontare le sfide affrontate dagli europei nei 60 anni dalla sua adozione.
Ma 60 anni sono tanti e molto è cambiato in Europa e nel mondo dall'ottobre 1961. Negli ultimi anni molteplici crisi hanno avuto - e continuano ad avere - un impatto negativo sull'effettivo godimento dei diritti sociali da parte di molte comunità in tutta Europa.
Se è vero che sfruttare le potenzialità del “sistema Carta sociale” costituisce una risorsa fondamentale per prevenire e superare tali crisi, è anche vero che questo sistema deve essere rafforzato e aggiornato, al fine di renderlo adatto ad affrontare le sfide che impegnano, oggi, la tutela dei diritti sociali in Europa.
In questa prospettiva, i relatori della convegno affronteranno un'ampia gamma di questioni cruciali, riguardanti sia l'ambito di applicazione materiale e personale della Carta sociale, sia procedure previste dalla Carta per monitorare il rispetto da parte degli Stati europei degli obblighi in materia di diritti sociali.

The University of Roma Tre (Department of Law, Roma Tre Centro Internazionale di Ricerca ‘Diritto e Globalizzazione’) together with the University of Nottingham Human Rights Law Centre, and with the support of the European Social Charter Department of the Council of Europe, invite you to a one-day conference marking the 60th anniversary of the European Social Charter.

Featuring expert speakers (academics, current and former members of the European Committee of Social Rights, high-level representatives of the Council of Europe), the conference will focus on “bringing the European Social Charter into changed times”.

The event, in blended mode, will take place in Rome, University of Roma Tre (Aula Magna), on 6 October, 10:15-17:15 CET.

The European Social Charter system is the most wide-ranging instrument providing for social rights in Europe. From workers’ rights to the protection against poverty and social exclusion, from the rights of persons with disabilities to equal opportunities for women and men, from the protection of health to the rights of migrants, the Charter with its monitoring machinery has proved a living instrument capable of engaging with the challenges faced by Europeans in the 60 years since its adoption.
But 60 years is a long time and much has changed in Europe and globally since October 1961. In recent years multiple crises have had - and continue to have - an adverse impact on the effective enjoyment of social rights by many communities across Europe.
If it is true that taking advantage of the Social Charter system’s potential constitutes a major tool for preventing and overcoming such crises, it is also true that this system needs to be strengthened and updated, in order to make it fit to meet the challenges that confront, today, the protection of social rights in Europe.
With this view, speakers in the Conference will address a wide range of crucial issues concerning both the material and personal scope of the Charter, as well as the Charter’s procedures for monitoring State compliance with social rights obligations.
