THIS IS AN ADVANCED COURSE, WHOSE AIM IS TO TACKLE SOME TECHNICAL ASPECTS OF THE MEDIEVAL AND EARLY MODERN LAW. STUDENTS ARE ASKED TO FACE THE ORIGINAL SOURCES AND TO TAKE INTO ACCOUNT HISTORIOGRAPHICAL QUESTIONINGS.

Programme

The course will be devoted to the history of the Legal fictions between Roman inheritance and Medieval innovations, and it will be divided into two sections:

1) Understanding of the concept of "Ius commune", with a specific attention to the founding moment of Ius Commune between the 12th and the 14th century.

2) History of Legal fictions, between Roman inheritance and Medieval innovations.

Students who will attend the lessons will be given reference literature during the course.

Frontal Lessons

Type of evaluation

For attending students, there will be two mid-term tests: one written test (end of October/beginnings of November) in order to verify the knowledges aquired by the students during the first month of lesson; one oral presentation (power point or oral exposition in the classroom) on a specific subject decided by the professor together with each student. The final exam is oral and it will consists of a conversation on the pivotal topics of the course.
