Aims and contents of the course
The course is aimed at providing the students, through a monographic study of the juridical phenomenon about the divergence between the wanted crime and the realized one, with instruments for a dogmatic and criminal-politic analysis, in an advanced and specialized way, of some of the main institutes of the general theory of crime, such as intention, negligence, unintention, mistake in fact – in particular, as to the specializing elements -, the so-called “aberratio”, the fortuitous event and the force majeure as general limits to the “personal” criminal liability. Based on the same methodological perspective, the analysis focuses on the main causes of extinguishment of crime.

Type of delivery of the course

The course of Criminal Law II (A-L) consists of teacher’s lectures and specialist seminars during the first semester of the academic year (October - December). Lectures take place on Mondays, Tuesdays and Wednesdays, from 10:00 to 12:00, in classroom 4 of Department of Law. Seminars take place on Tuesdays from 8:00 to 10:00, in classroom 9 of Department of Law. In particular, during specialist seminars, students study cases of error in Criminal Law.

Attendance

Class attendance is not mandatory. Lectures take place on Mondays, Tuesdays and Wednesdays, from 10:00 to 12:00, in classroom 4 of Department of Law. Seminars take place on Tuesdays from 8:00 to 10:00 in classroom 9 of Department of Law.

Type of evaluation

The exam is oral and students have to demonstrate knowledge of the main topics of Criminal Law, such as the most important cases of error as far as the subject is concerned, and reasoning skills. Evaluation is expressed in thirtieths and the exam is passed with marks from 18/30. There are three exam dates during the winter session (January - February) and three dates during the summer session (June - July), while, during the autumn session (September), there are only two exam dates. Extraordinary session takes place on one day in November. There aren’t intermediate tests.
