Programme

The course will focus, at first, on the sources of Administrative Law, that is the normative acts regarding public administration institutions and key principles governing their activities.
Second, we will analyze the organizational structure of public administration institutions, with particular regards to its territory organization, the juridical subjects of which it is composed, and the operational, human and financial resources used.
More, we will analyze in detail authoritative activities of public administrations - highlighting the administrative proceeding process, the administrative act process and related pathologies – and consensual activities as well.
The course will then focus on the subjective legal rights of individual citizens facing public administration and the related form of protection.
Finally, the course will treat the relationship between public power and different market actors, such as regulators, private and public networks, public services operators, infrastructures and establishments of public demand.

Programme

The course will be based on five different sections.
In the first one the main topic consists in analysing the strategic relationships inside ADMINISTRATIVE LAW (AL), especially about the historical and political processes that give birth to administrative functions.
In the second place, the class will shift its attention on the organization of public administration (PA), by highlighting how each structure is characterized by a different logic of collective action.
In the third place, the class will discuss how the PA works, by focusing on the main public power’s features and administrative discretion (i.e. contractual freedom).
From this moment on, the fourth sections will deepen the different approaches to regulation (both authoritative and contractual) in order to understand how individuals can be preserved by abuses of public power. Therefore, the last sections will be dedicated to the study of the safeguards set up by law for those who complain about the violation of their rights and interests.
The teaching style consist in cases’ discussions.

Type of delivery of the course

The lessons will be frontal. During the latter, specific practical and jurisprudential cases will also be analyzed and discussed. Active participation of students during lessons is strongly encouraged, through common questions, interventions and discussions.

Attendance

The students of the course are divided into attending and non-attending students. Special rules apply to Erasmus students. Attending students are those who are present in the classroom and actively participate in the lessons. The signatures of the present ones will be collected and a record of the interventions carried out in the classroom will be kept. Absences are allowed for a maximum of three lessons in each of the two teaching blocks (first block: modules I, II, III, second block: modules IV, V). It is necessary to participate in the common discussion at least three times in each teaching block. The course attendance, although recommended, is not mandatory. Non-attending students, therefore, will be able to take the exam on the entire program according to the methods indicated. The exam can also be supported by incoming and outgoing Erasmus students. The frequency of lessons is recommended especially for the former. Type of evaluation

In the summer and autumn session of the 2019/2020 academic year, the exam will be remotely only in written form, on the Moodle Platform. During the COVID-19 emergency period, the exam will be carried out according to the provisions of art. 1 of the Rectoral Decree n. 703 of May 5,2020. Attending students Attending students will take two intermediate written tests, at the end of each of the two teaching blocks. The tests will have as their object the general institutes and the jurisprudential cases discussed during the lessons (up to the date of the test), as well as the chapters of the manual relating to them. The test will consist of three open-ended questions (maximum 15 lines), evaluated in tenths, for a total score of 30. The test will last 30 minutes. In particular, the student must frame the legal institution and recall the principles and legal issues arising in the relative cases. Students are therefore required to be able to synthesize and connect, qualities which are indispensable for the formation of the jurist in contemporary society. For educational purposes, the teacher reserves the right to change the way the intermediate tests are conducted during the year. In this case, together with the publication of the decision with a specific notice on the site, the present document will be modified, in its online version as published in the notices section of the teacher's page on the department website as well as in Elearning. It is also possible to face just one of the written tests. Any failure to achieve sufficiency makes the test invalid for passing the exam under the conditions provided for attending students. The votes assigned to the exemptions are valid for two sessions (summer and autumn). The particularly qualified and appropriate participation of the students in the discussion of the cases during the course may, in the opinion of the teacher, allow the attribution of one or more points to be added to the vote of the exemptions. The same will happen in the case of participation in conferences and seminars indicated during the course. Non-attending students For non-attending students, the exam consists of a written exam that will focus both on the manual and on the jurisprudential cases published on the Elearning platform. The written test will consist of three open-ended questions (maximum 15 lines), evaluated in tenths, for a total score of 30. The test will last 30 minutes. In particular, the student must frame the legal institution and recall the principles and legal issues arising in the relative cases. For the best preparation for the written test, students are advised to practice individually with specific simulations.
