The course aims at offering an interpretation of the penitentiary law according to the terms of the Constitution, with a both theoretical and practical approach, particularly focused on the application of rules in the practice and in the jurisprudence, at national level and beyond. Based on this point of view, in which the “constitutionalistic” shade prevails, the course means to enlarge the cultural baggage of our students, combining the knowledge they already got in different fields (constitutional law, philosophy of law, criminal law, rules of criminal procedure, international law, ecc.) with the basic teaching of our degree course.

Programme

Type of delivery of the course

Frontal lessons. Some lessons will take place in the penitentiary institutes of Rebibbia Nuovo Complesso, Regina Coeli and Rebibbia for women (legal clinic).

Type of evaluation

- Written test of the legal clinic: the students, divided into groups, must write a report containing the solution of the legal questions presented during the meeting of the legal clinic organized at the penitentiary institute of Rebibbia. At the end of the course, each group exposes its solutions in the classroom, facilitating discussion on each case. - Intermediate written test: during the course students can take an intermediate written test on the constitutional principles regarding the deprivation of personal liberty. - Final oral exam: students must answer two oral questions regarding the program. The test is evaluated with a score from 18 to 30 based on the knowledge of the program and of the technical language. Honour is given to students with excellent knowledge of the program, excellent technical language and analytical ability
