20110284 - Attività: Canonical jurisprudence

The aim of the activity will be the knowledge of the canonical jurisprudence on matrimonial cases with particular reference to the jurisprudence of the Roman Rota.
To this end will be provided the main theoretical notions regarding canonical marriage and its elements and the canonical procedure for obtaining marriage nullity. These will be followed by the analysis of some jurisprudential cases.
The student will thus be able to evaluate how the jurisprudence of the Roman Rota guides the jurisprudence of the local canonical courts.

Programme

The course will take place on a weekly basis starting from March 2, 2020 and until May 30, 2020, for a total of 20 hours. The course will be divided into two parts. The first will be dedicated to the theoretical notions concerning the grounds for matrimonial nullity and the aspects of canonical procedural law will be provided with particular reference to the canonical matrimonial procedure. The second one will be dedicated to practical exercises on some jurisprudential cases of particular relevance.

Type of delivery of the course

The course will take place through lectures of the theoretical part. As regards the jurisprudential part, the analysis of the practical cases is foreseen with relative discussion. In particular will be analyzed the jurisprudence of the Tribunal of the Roman Rota on the nullity of canonical marriage.

Attendance

Attendance to the course is optional. The previous attendance at the canon law course is suggested.

Type of evaluation

At the end of the lessons there will be an oral test aimed at evaluating the following elements: - understanding of the topics covered during the lessons; - language skills; - ability to present the topics and their interconnections.
