The seminar activity aims at framing the theory of counter-limits in the light of the democratic principle and the sovereignty of citizens, through a comparison among the jurisprudential orientations of different national constitutional courts with particular reference to the Italian Constitutional Court.

The seminar deals with various aspects of the relationship between the EU legal system and national legal systems. The German Federal Constitutional Court’s judgment of 5 May 2020 is an opportunity to investigate the limits of the European Union legal system and, more specifically, the role of the Court of Justice and its powers. The subject of the ruling was the legitimacy of the Public Debt Purchase Program, established by the European Central Bank. The German Court considers ultra vires and devoid of validity and effectiveness the previous judgment of the Court of Justice.Type of evaluation
