The course aims at providing students with the theoretical tools for an in-depth knowledge of the following elements of the EU integration process: a) institutional structure of the European Union; b) system of sources; c) articulation of competences; d) judicial guarantee system; e) relationship between the law of the European Union and the law of the Member States; f) Union policies, with particular reference to the matters that fall within the creation of the area of freedom, security and justice.

Programme

The course is divided into two parts and focuses on the analysis of the main aspects of the European integration process and the results achieved in the implementation of the CFSP and the area offreedom, security and justice. In the first part, the institutional structure of the Union, the system of sources, the decision-making process, judicial protection and the relationship between Union law and States’ legal orders will be examined. In the second part, the most relevant results achieved in the construction of the area of freedom, security and justice will be examined with particular reference to the free movement of persons, immigration and border control policy, the common policy on asylum and international protection, police cooperation. The course includes the presentation and discussion, also in seminar form, of the most relevant judgments of the Court of Justice.

Type of delivery of the course

Attending the course, students take part in a specific learning path that aims at developing the ability to analyse the acts adopted by the institutions of the European Union and the case-law of the Court of Justice. The first part of the course is held with traditional frontal teaching with the aid of power point presentations to allow students to focus on the fundamental aspects concerning the structure and functioning of the legal system of the European Union. The second part of the course engages in an active participation of the students through seminars that will involve them in the study and presentation of the most significant judgments concerning recent developments in the area of freedom, security and justice of the European Union. Particular attention will be paid to enhancing teamwork in the simulation of judicial proceedings before the Court of Justice.

Type of evaluation

The exam will take place in oral form according to a subdivision of students enrolled in the exam by time slots that will take into account the extracted letter. Each session will start on the days indicated in the exam calendar and may continue on the following days based on the number of students enrolled. In order to ensure the orderly and regular performance of the work, students who decide not to attend the exam, for which they have registered, are invited to cancel their registration no later than the deadline for the reservation in the Gomp system. We trust in the effective collaboration of the students in order to be able to organize each session based on the actual number of those present.
