20110253 - Attività: Religious freedom in the european context (coe-eu)

Since the Second World War, religious freedom has conquered space in the sources of the law, case-law and policies of the Council of Europe and European Union. These sources affect the national systems and make same trends in different Member States. In this framework, the course will provide the historical and legal bases for understanding the conflicts characterized by religious and ethnic/religious impact, with particular reference to relationships between the European institutions and Religious Organizations; balancing with other principles and freedoms of the European legal systems (secularism, freedom of thought, equality, freedom of economic activity, physical integrity, etc.)

Programme

Origins and development of religious freedom in the European context. Religious freedom in the law and political action of the Council of Europe. The competence and actions of the European Union The impact of secularization and multiculturalism: analysis and discussion with students of the most common religious conflicts through the case law of Cedu and CdUE, with particular reference to the relationship between religious pluralism and democratic society; neutrality and religious symbolism; freedom of expression and criticism v. protection of religious sentiment; educational freedom of parents/students v. educational power of the State; individual religious freedom v. rights of the enterprise and the ideological organization.

Core Documentation

The participants will be provided with doctrinal texts, the sentences, and bibliographical indications of further study, also through the e-learning portal.

Type of delivery of the course

Subscription by mail : rita.benigni@uniroma3.it, registration will only be possible until the first lesson 28 October 14:00 on TEAMS The course is divided into lectures beginning in mid-October - ON LINE. Attendance is compulsory.

Type of evaluation

Report presented and discussed with other participants, during the course, OR Report presented and discussed with the teacher during the exam. Report and discussion are aimed to verify knowledge of the topics covered; the autonomy of judgment in evaluating the institutions and the cases examined; the ability to express oneself in a language that is also legally appropriate.
