The course examines the following themes: the security of rights and human dignity; the creation of law and, in particular, the relationship between the Constitution and ordinary laws; the Italian system of constitutional justice, with special regard to the interpretation in conformity with the Constitution.

THE COURSE AIMS AT STUDYING THE SYSTEM OF THE SOURCES OF LAW AND OF CONSTITUTIONAL REVIEW. THE ANALYSIS WILL FOCUS IN PARTICULAR ON THE ISSUES RELATING TO THE DEMOCRACY AND TO THE IMPACT OF THE EU LAW ON THE ITALIAN LEGAL ORDER.

GENERAL PART
The creation of law. Constitution, ordinary laws and other sources ok law.Constitutional justice – Fundamental Rights - Constitutional Court: composition, the judgment concerning constitutional legitimacy, conflicts arising over the allocation of powers, charges against the President of the Republic, admissibility of referendums.

SPECIAL PART
The interpretation in conformity with the Constitution: the role of the Constitutional Court and the other courts in “doing constitutional justice” for a better protection of rights.

Oral examination Usually three questions will be asked on different topics of the program. To pass the exam, an adequate property of technical-legal language and at least fundamental knowledge of the required topics are required.

Type of delivery of the course

The frontal lessons will be dedicated to the programme. In the event of an extension of the health emergency by COVID-19, all the provisions governing the way in which teaching activities and student evaluation are carried out will be implemented. In particular, the lessons, if necessary, will take place remotely through the interactive Microsoft Teams platform, made available by the University.

Type of evaluation

The oral exam checks the level of understanding and knowledge of constitutional law, also in light of the jurisprudence of Italian Constitutional Court. Students will answer questions asked about the program, with reference to the recommended texts and lectures. The evaluation ranges from a minimum of 18/30, corresponding to the basic knowledge of all parts of the program and technical language, to a maximum score of 30/30 and honors, which is equivalent to mastery of the topics, excellent language property, excellent analytical ability.
