20110750 - Activities: Principles and rules on public procurement

The course aims to implement the teaching offer of the Department by offering an in-depth analysis of the principles and rules governing the award of public contracts. The course aims to develop in the student the awareness of the importance of public procurement procedures in the internal and supranational legal system, which sector is strategic both for the economy and for the pursuit of public purposes beyond the choice of the best contractor at the best conditions available. The interest in deepening this special branch of administrative law in the perspective of the "principles and rules" is made even more relevant by the entry into force of the new Code of public procurement (d.lgs. n. 36/2023) which finds one of the most innovative points precisely in the introduction of a comprehensive regulation of the principles applicable to the matter. The course will be conducted with a "casistic" and "problematic" approach, always considering the case-law and the concrete application of the rules at stake.

- The phase of participation and selection of offers (regulation of exclusions)
- The National Anti-Corruption Authority (ANAC)
