The aim of this module is to stimulate students' interest in the subject studied in Administrative Law also through the analysis of case law. The course will focus, in the first half, on some issues of substantive Administrative law (with specific reference to the rules of administrative action) and the second part in a survey of the " features" of the system of Administrative justice.

The course for non-attending students includes the study of the text: L. Torchia, Lo Stato digitale. Una introduzione. Second edition, Il Mulino, 2025 (all chapters) and the exam consists of an oral test. The book analyses the main problems that the development of information and communication technologies poses for public law: the emergence of the digital state, the relationship between technology and democracy, the EU regulation of artificial intelligence, the use of technology in decision-making processes and administration, and thr digital justice. For each topic, not only are the developments in the discipline reconstructed, but also the related legal and institutional issues, the scientific debate, and jurisprudential trends, with extensive references to experiences in other countries. Non-attending students, through the study of the text, will be able to carry out a complete analysis of the subject matter, the transformations and the prospects opened up in this specific sector.
The course for attending students involves the study of the text by L. Torchia, Lo Stato digitale. Una introduzione. Second edition, Il Mulino, 2025, but based on the indications and specific materials that will be illustrated during the first lesson. The course is divided into modules dedicated to specific topics and issues in administrative law, which require students to have acquired the basic knowledge covered in the Administrative Law I course. The course for attending students includes lectures, with illustrations and study of specific problems and cases, with exercises and discussions on the basic materials provided to students and illustrated during the lessons. Written tests are only for attending students. Attending students may request that their written exam mark be recorded, or they may request to take an oral exam as well.
For Erasmus students
The Administrative Law II exam can be taken as part of the Erasmus Program by respecting the procedure set out in the teaching regulations, with a prior request to the teacher. In this regard, please note that the teaching regulations provide that "for the purposes of completing the Learning Agreement, each interested teacher of the Faculty of Law of Roma Tre must be contacted by the student through the relevant area contact person. The contacted teacher must provide the own opinion on the proposed full or partial replacement, agreeing on the possible integration of the program".
