20101097 - CONSTITUTIONAL LAW

This course builds on the foundations of constitutionalism to equip students with a deep understanding of Italian constitutional law and its place within the broader international and supranational context. Key areas of focus include the dynamics of power, law-making processes (especially the interplay between the Constitution and legislation), rights protection and human dignity, and Italy's constitutional justice system.
Students will be encouraged to integrate their learning from this course with insights gained from other disciplines.

There is an oral exam consisting of two parts: the first in front of a commission; the second in front of the Professor.

GENERAL PART
Power, Right, Order - The creation of law - Sources of law - Constitution, ordinary laws and other sources of law - Fundamental Rights - Constitutional justice –Constitutional Court: composition, the judgment concerning constitutional legitimacy, conflicts arising over the allocation of powers, charges against the President of the Republic, admissibility of referendums.

SPECIAL PART
Constitutional Court review and legislative discretion.

The students are also asked to study the Constitution and the most significant laws on constitutional issues. The Constitution and the above mentioned laws can be downloaded from the Italian institutions’ websites (e.g. www.cortecostituzionale.it; www.parlamento.it ).
The knowledge of Public Law course’s contents is required.

Type of evaluation

Oral examination. Usually three questions will be asked on different topics of the program. To pass the exam, an adequate property of technical-legal language and at least fundamental knowledge of the required topics are required.

Type of evaluation

The oral exam checks the level of understanding and knowledge of constitutional law, also in light of the jurisprudence of Italian Constitutional Court. Students will answer questions asked about the program, with reference to the recommended texts and lectures. The evaluation ranges from a minimum of 18/30, corresponding to the basic knowledge of all parts of the program and technical language, to a maximum score of 30/30 and honors, which is equivalent to mastery of the topics, excellent language property, excellent analytical ability.
