The course aims to explore the constitutional dimension in which the development of Artificial Intelligence (AI) fits, analysing the opportunities and risks for individual rights and freedoms arising from technological innovation, and also examining the contribution that constitutional principles can offer in guiding the regulatory framework applicable to AI.At the end of the course, students will have acquired a basic knowledge of the dynamics associated with the implementation of artificial systems and will be able to grasp the impact that AI can have on the main areas of the state-citizen relationship.

Programme

The course explores the constitutional framework within which the development of Artificial Intelligence and the construction of Cybersecurity take place. These two domains are examined both as autonomous components and as interconnected elements of the digital society, with particular attention to opportunities and risks for individual rights and freedoms, substantive equality, security, public accountability, and the continuity of essential services.
The analysis is conducted in light of Regulation (EU) 2024/1689 (AI Act), Law No. 132 of 23 September 2025, Regulation (EU) 2026/1744 (Digital Omnibus on AI), Directive (EU) 2022/2555 (NIS2), and Legislative Decree No. 138 of 4 September 2024.
At the end of the course, students will be able to reconstruct the main governance models of AI and cybersecurity, identify the fundamental obligations, and assess their impact on the relationship between public authorities and citizens.

Type of evaluation

The assessment will be carried out through an oral exam, with on 3/4 questions relating to the exam syllabus. In assessing the exam, the final grade will take into account the level and quality of knowledge of the topics; the ability to critically analyze a topic; the logic of the arguments supporting a thesis; as well as the use of vocabulary appropriate to the discipline being studied.
