Ecology legislation (Dr. Alfonso Contaldo)

Module 1 (6 hours)
The profession of biologist. The law establishing the Order of Biologists: main aspects; the reform of registers and competences with the regulatory intervention of 2001; Main skills of the freelance biologist (exclusive and in competition with other professional figures); The skills of the Biologist registered in the special list and the limitations to ultracontractual activities; The limited competences of the cd. Junior biologist and his eventual registration on the Special List; The deontological code of the profession of the Biologist approved in 2019; The sanctioning procedures for violations of professional obligations and the sanctions provided for by biologists also enrolled in the special lists and any repercussions on the employment relationship established with their public and / or private employer.

2nd module (8 hours)
The UN, its specialized agencies, and international conventions on the environment (in general and differences between UN legislation and international treaty legislation between states); The European Union and the sources of law (difference between Directive and Regulation); The State (the system of national sources, difference between constitutional, legislative and regulatory norms) and the competences of the Ministries regarding the environment; territorial public bodies (Regions, Municipalities, Metropolitan Cities) and non-territorial bodies (research bodies in the sector) with environmental competences; the value of the legal rule and the territorial scope of validity; the technical rule and its impact on the legal rule.

Module 3 °: (8 hours)
Environmental protection in the international context: a) The Agreement between States, officially the Convention on Wetlands of Importance, signed in Ramsar (Iran, 1971); b) The United Nations Conference on the Human Environment (convened by resolution of the UN General Assembly of 1968) in Stockholm (Sweden, 1972); c) The United Nations Conference on Environment and Development (convened by UN resolution of 1991) in Rio de Janeiro (Brazil, 1992); d)
The United Nations Framework Convention on Climate Change, cd. UNFCCC, defined in New York (1992, USA) and the subsequent Kyoto Protocol (1997, Japan); e) The Word Summit on Sustainable Development (convened by UN resolution) in Johannesburg (South Africa, 2002); f) The United Nations Conference on Sustainable Development cd. Rio + 20 of Rio de Janeiro (Brazil, 2011); g) The United Nations Summit on Sustainable Development (convened by the Rio + 20 Conference) held in New York (2015, USA) and Agenda XXI or the Program of Action for People, the Planet and Prosperity which encompasses sustainable development; h) United Nations Conference on “Climate Change” held in Paris (2015, France).


4th module (16 hours)
The Italian environmental regulations: a) constitutional protection; b) the institutional set-up for environmental protection in a multilevel governance system and command and control tools (Ministry of the Environment, regional environmental departments and regional ARPA), economic and voluntary membership; c) the Environmental Code (Legislative Decree no. 152/2006); d) the discipline of the so-called protected areas; e) the protection of the marine environment; f) the protection of the hydrogeological structure; g) water protection and management; g) waste management; h) protection from noise pollution, atmospheric and electromagnetic pollution; i) the control of greenhouse gas emissions; l) strategic environmental assessment (SEA), environmental impact assessment (VIA), impact assessment (VINCA); m) the integrated environmental authorization (AIA) and the single environmental authorization (AUA); n) the cd. environmental damage and the remediation of polluted sites: administrative, civil and criminal safeguards.
