Programme
The course examines the conflict between law and justice, beginning with classic texts such as the tragedy of Antigone and Socrates’ Apology. It will then explore the emergence of modern criminal law during the Enlightenment, with an in-depth look at the works of Montesquieu and Beccaria and the principles of due process in criminal law, up to the essays of Luigi Ferrajoli. Finally, we will analyze the differences between legal positivism, natural law theory, and constitutionalism.Core Documentation
